1. About This Policy
This Privacy Policy describes how Clariva (operated by Tanner Spadafora) collects, uses, and protects the personal information of users at clariva.ca. This policy is governed by Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Quebec's Law 25. Tanner Spadafora is the designated Privacy Officer. 2. PIPEDA's 10 Fair Information Principles
Our practices are built around PIPEDA's ten principles:
3. What Information We Collect
Information you provide directly:
Business information: Industry, province, annual revenue, net income, depreciation and amortization, EBITDA, company name (optional), your valuation estimate, and your intent (e.g., just curious, considering selling, actively looking).
Contact information: Email address (required for verification), phone number (optional), LinkedIn profile URL (optional).
User type: Whether you are a business owner, student, or investor, and follow-up context based on that selection.
Information collected automatically:
When you use the platform, we may collect your IP address, browser type, and pages visited for security and platform improvement. We do not use advertising trackers or sell this data.
4. Why We Collect It and How We Use It
To generate your valuation benchmarks: Your business financials are used to calculate a valuation range based on industry multiples and peer comparison data.
To build the peer comparison dataset: Your submission is anonymized and aggregated with others to create the industry benchmarks shown to all users. No individual submission is ever displayed or attributed to a specific person or business.
To send you your results: Your email address is used to send your verification link and valuation report.
To send optional updates: If you opt in, we may send quarterly industry data updates. Unsubscribe at any time.
To facilitate optional buyer contact: If you explicitly opt in, we may share your contact details (not your financials) with vetted acquirers. Strictly opt-in. Revocable at any time by emailing tanner@clariva.ca.
For industry research: Anonymized, aggregated data may be used to generate industry insights. Individual data is never included in research outputs.
5. What We Do Not Do
We will never: sell your individual data to any third party; share your specific financial information or business identity with buyers without your explicit consent; use your data for purposes materially different from those stated without obtaining fresh consent; or use your information for advertising targeting on third-party platforms.
6. Data Sharing
Service providers: We use reputable third-party cloud infrastructure providers for database hosting and email delivery to operate the platform. These providers process data on our behalf under data processing agreements.
Legal requirements: We may disclose information if required by law, court order, or government authority with legal jurisdiction to compel disclosure.
Business transfer: If Clariva is acquired or its assets transferred, personal information may transfer as part of that transaction. We will notify verified users in advance.
7. Data Retention
We retain your personal information for as long as your submission is active or as needed to provide the platform's services. Upon deletion request, we will remove your personally identifiable information within 30 days. Anonymized data that cannot identify you may be retained indefinitely as part of the aggregate dataset.
8. Your Rights Under PIPEDA
You have the right to: (a) access the personal information we hold about you; (b) correct inaccurate information; (c) withdraw consent for non-essential uses; (d) request deletion of your personally identifiable information; and (e) file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca) if you believe your rights have been violated.
To exercise any of these rights: tanner@clariva.ca. We will respond within 30 days.
9. Security
We use industry-standard security measures including encrypted cloud database storage, email verification, and HTTPS encryption for all data in transit. In the event of a data breach posing real risk of significant harm, we will notify affected users and the Office of the Privacy Commissioner as required by PIPEDA's mandatory breach notification rules.
10. Children's Privacy
Clariva is not intended for users under 18. We do not knowingly collect information from minors. If we become aware we have done so, we will delete it promptly.
11. Changes to This Policy
We may update this policy periodically. The date at the top reflects the most recent revision. Material changes will be communicated by email to verified users where possible.
